TERMS OF USE

1. AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you and ANF Consulting (doing business as Everly), concerning your access to and use of the Everly application and website. By accessing or using Everly, you agree that you have read, understood, and agreed to be bound by all of these Terms of Use. If you do not agree, you must discontinue use immediately.

2. DESCRIPTION OF SERVICE

Everly is a SaaS application that provides real estate professionals and small business owners with AI-generated daily marketing content, including social media posts, blog articles, and task checklists to help users build consistent marketing habits. The Service is intended for personal and internal business use.

3. ELIGIBILITY

You must be at least 18 years of age to use Everly. By using the Service, you represent and warrant that you meet this requirement.

4. USER ACCOUNTS

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

5. SUBSCRIPTIONS AND BILLING

Everly is offered on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless cancelled. You may cancel at any time through the billing portal in your account settings. Cancellations take effect at the end of the current billing period.

All payments are processed by Stripe. We do not store your payment card information.

6. REFUND POLICY

Refund requests are handled on a case-by-case basis. To request a refund, contact us at anfaiconsulting@gmail.com. We reserve the right to approve or deny refund requests at our discretion.

7. AI-GENERATED CONTENT

Everly uses artificial intelligence (powered by OpenAI) to generate marketing content for you. You acknowledge that:

• AI-generated content may not always be accurate, complete, or suitable for your specific needs
• You are solely responsible for reviewing, editing, and approving any content before publishing it
• We make no guarantees about the performance or results of any AI-generated content
• You retain ownership of content you publish; we do not claim ownership of your outputs

8. PROHIBITED ACTIVITIES

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to send spam or unsolicited communications
• Violate any applicable laws or regulations
• Share your account credentials with others

9. INTELLECTUAL PROPERTY

The Everly application, its original content, features, and functionality are owned by ANF Consulting and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes.

10. THIRD-PARTY SERVICES

Everly integrates with third-party services including Stripe (payments), Supabase (database), and OpenAI (AI content). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

The Service may also contain links to third-party websites (such as blog publishing platforms). We are not responsible for the content or practices of those websites.

10a. ANALYTICS

We use Google Analytics to collect anonymised information about how users interact with the Service, including pages visited, time spent, device type, and general location (country/region). This data is used solely to improve the Service. Google may process this data in accordance with their own privacy policy, available at https://policies.google.com/privacy. You may opt out of Google Analytics tracking at any time by installing the Google Analytics Opt-out Browser Add-on available at https://tools.google.com/dlpage/gaoptout.

11. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, ANF CONSULTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

13. DISPUTE RESOLUTION

Any disputes arising out of or relating to these Terms or the Service shall first be addressed through informal negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in the state of Ohio, United States, in accordance with applicable arbitration rules. You agree to waive any right to a jury trial or class action.

14. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

15. UPDATES TO THESE TERMS

We reserve the right to update these Terms at any time. We will notify you of material changes by email at least 7 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. TERMINATION

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by cancelling your subscription and contacting us.
